When people buy scalped tickets, they are not buying them from the team that issues them, so they can't complain that the team mislabeled the tickets. When you see the tickets advertised on StubHub or ebay, you only see the price that they are charging and you know that isn't the face value. You are not deceived, just as when you buy a rare penny that is worth $100 you know that you are paying more than the ONE CENT that appears on the coin. Or perhaps more relevant here, when you pay above face value for a baseball program from a historic game or a baseball card of a favorite player. Just because that program from the 75 World Series says $1 and you pay $100 doesn't mean you have been ripped off. <BR/><BR/>People who pay scalpers are not tricked into paying more---they know exactly what they are doing.<BR/>I repeat that as a consumer I don't like what has happened with ticket prices, but I don't see it as immoral. If we live in a free market, this is the behavior we have to expect. I did, by the way, try to get tickets at the Sox website, but every game we wanted to go to was sold out---even though listed there as having tickets. Plus the cheapest tickets were $90 --- I love baseball, but it still hurts our budget to pay $180 for a game---plus parking, outrageous prices for beer/soda/snacks. So even face value breaks the bank for us. Maybe once a season, but not much more. We are lucky to have a friend with season's tickets who invites us once a season, plus my school usually buys a block of grand stand seats once a season.<BR/><BR/>Anyway, on your larger point, first off, in many places, third party selling of the tickets at a premium price is no longer illegal, e.g. in New York State. Secondly, it may be morally wrong (though I am not sure many would agree even with that), but it is not unlawful to buy up stuff and sell it at a higher price. People do that on ebay all the time after buying stuff at Costco, etc. My father-in-law, who was a scrupulously honest businessperson, used to buy toothpaste at discount stores and resell it at his pharmacy at a higher price. Unless someone has a monopoly on a certain kind of product or unless they are engaging in deceptive behavior or perhaps violating some other specific consumer protection statute provision, that soda guy is just doing what our system says he can and should do---make money.<BR/><BR/>I think what makes this seem so unfair with tickets is that these agents somehow have the means to get the tickets before we, the public, even get a chance, and that baseball tickets cannot be considered equivalent to some other entertainment event if you want to see a baseball game. It is almost like a monopoly, except that there are so many out there engaging in the same behavior, not just one vendor. If your soda guy charges too much for soda, we can decide to buy soda elsewhere or drink water or juice or whatever. Yes, the face value prices are high, but I think that's what goes along with the rest of society. The price of a soda at a vending machine used to be 25 cents, and now it's 1.25. That's an example of the normal evolution of the economy. But I'm complaining about the equivalent of having to pay ten dollars for the soda because some dude went to the machine and bought them all in the first minute and then started selling them--illegally, mind you--on his own. <BR/><BR/>And had a network of people going to each machine taking all the sodas from all of them, knowing that if they have all the sodas, they can charge whatever they bloody well please--even thought the law was supposedly put in place to prevent this.
