After saying repeatedly that Roger Clemens will answer any questions Congress wants to ask him, a source familiar with the inquiry said Saturday night that attorney Rusty Hardin is hedging over the House Oversight and Government Reform Committee's request to depose Clemens under oath next week because it might interfere with his defamation lawsuit against personal trainer Brian McNamee. If Billy backs down, then it's Subpoena Time!
Alan Schwarz has a good piece in the Times about the strategy Clemens and Hardin are taking. Marina Ein, a crisis-management consultant based in Washington, DC, on Clemens's 60 Minutes appearance:
He fell into a trap he didn't see. Early in the interview, he said about steroids, "Where would I get the needles?" But later, talking about how McNamee's injections were only lidocaine and vitamin B12, apparently needles were no problem. I guarantee you that the authorities are going to jump all over that. He did exactly what you should fear would happen.

Here you go!
am pretty sure that someone mentioned that this was a possible defense for non-appearance / being mum in front of congress in the comments on one of these posts.
I still have a bad feeling about this whole mess.

You mean, you're afraid we might not see Roger go down in flames?
:>)
...
If he says he won't go to Congress and talk and is then ordered to appear, he probably take the 5th. Which won't be good for his PR push.

Actually after listening to McNamee's conversation and looking at his other personal problems (jail, dying son etc) am worried about him doing something stupid.
The Roidger going down in flames I think is assured.
Well at this point unless he can unequivocally clear his name through punitive judgments levied against his accusers, his HOF bid is in Pete Rose land.

Well, at least all this mess will put the annual speculation about his return from retirement on hold for awhile, huh?
